1. Agreement
These Terms of Service (“Terms”) are an agreement between you and GigaDuck OÜ (“we,” “us,” “our”), a private limited company (osaühing) incorporated under Estonian law, registry code 17501858, with registered office at Tornimäe tn 5, 10145 Tallinn, Estonia.
They govern your use of the 1000 Lives app for iPhone and Android (the “App”) and the 1000 Lives website and waitlist at 1000lives.app. By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
If you download the App from the Apple App Store or Google Play, that store’s terms also apply to the download and to any purchase you make there. For App Store downloads, Apple’s Standard Licensed Application End User License Agreement applies alongside these Terms.
How we handle your data is explained in the 1000 Lives Privacy Policy.
2. Early Access
1000 Lives is new and still being developed. Early-access versions may have missing features, bugs, or interruptions, and features, languages, stories, and art styles may change. Joining the waitlist does not guarantee access or a launch date; it only means we will email you when early access opens.
3. What 1000 Lives Is — and That It Uses AI
1000 Lives is a language-learning app built around spoken stories. The characters, narrators, tutors, stories, translations, corrections, and images in the App are generated by artificial intelligence. When you speak with a character, you are talking to an AI system, not a person.
To do this, the App sends your speech and text to AI providers that transcribe it, write replies, produce spoken audio, and create images (Section 9 and the Privacy Policy).
4. Eligibility and Your Account
You must be at least 18 years old to use the App or join the waitlist.
You sign in with your email address and a one-time code. Please give an email address you control and keep access to it secure: anyone who can read your email can sign in to your account. An account is for one person. You can delete your account at any time in Profile → Account → Delete account.
5. Your Content
“Your content” means what you put into the App: what you say and type, the story ideas you describe, the notes you write, and the phrases you save.
- You keep what’s yours. We claim no ownership of your content.
- Permission to run the App. You allow us, and the providers that work for us, to process your content only as needed to provide the App to you — for example, to transcribe your voice, generate replies and stories from it, and save it to your account.
- We don’t use your content to train AI models, and we don’t publish it.
- Your responsibility. Only submit content you have the right to use. Don’t include sensitive personal information — about yourself or anyone else — that a language lesson doesn’t need.
Deleting your account deletes your content as described in the Privacy Policy.
6. AI-Generated Content
- It is fiction. Stories, characters, and events are made up. Any resemblance to real people, places, or events is coincidental, even when a story is set in a real city or era.
- It can be wrong. AI makes mistakes. Translations, corrections, grammar explanations, and transcriptions may be inaccurate or incomplete, and speech recognition works better or worse depending on your microphone, surroundings, and accent. Check anything important with another source.
- It is not advice. Nothing in the App is professional, medical, legal, financial, or cultural advice, and it does not certify your language level.
- No guaranteed results. We design 1000 Lives to help you practise, but we cannot promise any particular learning outcome.
- Images and stories are made for you. You may use what the App creates for you for your own personal, non-commercial purposes. Because AI can produce similar results for different people, we do not promise that generated content is unique.
If the App produces something offensive or harmful, please tell us at info@gigaduck.ai.
7. Acceptable Use
You agree not to:
- use the App for anything unlawful, or to create content that is illegal, sexually explicit involving minors, or that harasses, threatens, or promotes violence against real people;
- try to make the AI produce such content, or deliberately work around the App’s safety measures;
- interfere with the App or our backend — for example, by overloading it, automating requests, scraping it, or trying to get around usage limits;
- access another person’s account, or share access to yours;
- copy, resell, or build a competing service from the App, its stories, or its generated content, or reverse-engineer it except where the law allows.
Please use the App safely: don’t use it in situations that need your full attention, such as driving.
8. Purchases
1000 Lives has not announced pricing yet. If the App offers a trial or purchases, the price and what it includes will be shown in the App before you pay. Purchases are made through the Apple App Store or Google Play and are billed, managed, and refunded under that store’s terms. Deleting the App or your account does not cancel a store subscription; manage it in your store account.
If 1000 Lives later lets or asks you to connect your own account with an AI provider to pay for your AI usage, that provider’s terms and charges will apply to that usage. We will explain this in the App and update these Terms and the Privacy Policy before it starts.
Nothing in this section limits your statutory rights as a consumer, including any right of withdrawal or remedies for a faulty product that the law gives you.
9. Third-Party Services
1000 Lives relies on other companies to work — including our backend host, AI providers for speech recognition, text, speech, and images, and the app stores. The Privacy Policy lists them. They are outside our direct control, and an outage at one of them can make part of the App temporarily unavailable.
10. Intellectual Property
The App — its software, design, the 1000 Lives name and logo, the curated stories, bundled art and sound, and other materials we provide — belongs to us or to our licensors. Some bundled recordings are used under licenses credited in the App under Profile → About 1000 Lives.
We give you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for your own non-commercial language learning, under these Terms and the store’s terms. We reserve all rights we do not expressly grant.
11. Availability and Changes
We provide the App “as available.” We may change, add, or remove features, stories, languages, or providers, and we may pause or end early access. Where a change significantly affects something you have paid for, we will respect your purchase and your consumer rights, including any required notice or refund.
12. Termination
You can stop using 1000 Lives at any time and delete your account in the App.
We may suspend or close your account if you seriously or repeatedly break these Terms, if your use puts other people or the service at risk, or if the law requires it. Unless there is an urgent reason not to, we will tell you why and give you a chance to respond. If we stop offering 1000 Lives altogether, we will give reasonable notice where we can.
When your account is closed, your right to use the App ends and your data is deleted as described in the Privacy Policy. Sections that by their nature should continue — such as 6, 10, 13, and 14 — continue to apply.
13. Disclaimers and Limitation of Liability
Your statutory rights come first. If you use the App as a consumer, nothing in these Terms takes away rights or remedies that mandatory consumer-protection law gives you, including your rights if the App is not as described or is defective. Nothing in these Terms excludes or limits our liability for intentional wrongdoing or gross negligence, for death or personal injury caused by our fault, or for any other liability that cannot be excluded or limited under applicable law.
Subject to the paragraph above, and to the maximum extent the law allows:
- we are not responsible for loss caused by relying on AI-generated content (Section 6) contrary to these Terms, or for loss caused solely by a third-party service outside our control (Section 9), unless the loss was caused by our breach of these Terms or by a defect in the App;
- we are not liable for loss that was not reasonably foreseeable when you started using the App; and
- if you use the App other than as a consumer, it is provided “as is,” without warranties of any kind, and we are not liable for indirect, incidental, or consequential damages.
14. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Estonia, without regard to conflict-of-law principles.
If you are a consumer, this choice of law does not deprive you of the protection of the mandatory consumer-protection rules of the country where you live. You may bring proceedings against us in the courts of Estonia or in any other court available to you under mandatory law — for consumers in the EU, the EEA, and the United Kingdom, that includes the courts of the country where you are domiciled. For non-consumer disputes, the courts of Tallinn, Estonia have jurisdiction.
Out-of-court options. If something goes wrong, contact us first at info@gigaduck.ai. If we cannot resolve the matter, consumers resident in Estonia may turn to the Consumer Disputes Committee (Tarbijavaidluste komisjon) at the Estonian Consumer Protection and Technical Regulatory Authority (ttja.ee/en/consumer-disputes-committee); consumers elsewhere may turn to an alternative dispute resolution body in their own country, or see the European Commission’s consumer-redress information at consumer-redress.ec.europa.eu.
15. Changes to These Terms
We may update these Terms when the App, the law, or how we offer the App changes — for example, when purchases become available. We will change the “Last Updated” date and publish the new version at 1000lives.app/terms. For significant changes, we will tell you in the App or by email at least 30 days before they take effect, unless the law requires a change sooner. Where the law requires your consent to a change, it will not apply to you until you give it. If you do not agree with a change, you can delete your account before it takes effect.
16. Miscellaneous
Entire agreement. These Terms, together with the app store’s terms for your download, are the entire agreement about the App. The Privacy Policy explains how we handle data; it is a notice, not part of this contract.
Severability. If a provision is unenforceable, the rest remain in effect.
No waiver. Not enforcing a provision is not a waiver of it.
Assignment. We may transfer these Terms to a successor (for example, in a merger or sale of the business) if your rights under them are not reduced.
Language. These Terms are written in English; the English version prevails to the extent consumer-protection law allows.
